Definitions:
"I", "me", "my", "Kelly" refers to Kelly Savage
"you", "your", "the customer" refers to the customer, the purchaser of items from this website, the person that requests a commission or the user of this website
By using or viewing this website or by purchasing any item featured on this website you are confirming your acceptance of these conditions. Sales:
This is an Agreement made under English Law between Kelly Savage and the Customer as defined below:
When you place an order the prices for the product and postage are detailed either in the Paypal payment or in communications from me. Your acceptance of that final price, your agreement to go ahead with the order or my receipt of payment from you is confirmation that you wholly agree to these Terms and Conditions.
Delivery dates are not usually given due to the unpredictable nature of the postal systems. Any delivery dates that are given to you should only be used as a guideline. I cannot and do not guarantee any delivery dates. Although I will endeavour to get an item to you for a specific date, due to varying postal services and international Customs I cannot guarantee it.
All items must be paid for in full, in cleared funds before they will be dispatched to you. Unless otherwise agreed I only accept payment by personal cheque or PayPal. In all cases funds must be cleared before any items will be dispatched to you.
Returns (models):
Returns are only accepted for certain reasons; if the item is faulty (see my Good Resin Guarantee below) or damaged due to improper packaging (see Damaged Goods below), the item must be returned to me at the expense of the customer. Once inspected and confirmed as faulty a full refund plus return postage will be issued or a replacement provided where possible (see "Limited Editions" below).
Returns for other reasons, such as "I changed my mind" or "I found another copy for sale so don't need this one any more" are also accepted on condition you have contacted me first, however the refund issued will be limited to the original sale price of the model less postage/packaging fees and is subject to the model being returned by the customer in its original condition and packaging.
Returns that fall outside of the terms above will be dealt with on an individual basis, please contact me to discuss.
Returns (commissions):
Drawings that have been commissioned are non-returnable subject to the drawing being completed to the customer's satisfaction and delivered undamaged.
All commissions are offered with a satisfaction guarantee based on images of the item sent prior to the posting of the drawing. Once confirmed satisfactory and handed over to the Post Office, this guarantee ceases. On arrival, should the item be unsatisfactory in any way other than postal damage, I reserve the right to refuse to refund any payments made or due. However, with reference to the paragraph above, please contact me to discuss any issues that arise.
Damaged goods:
Any damage caused due to insufficent packaging is covered, however this must be assessed and agreed by Kelly before return, replacement or refund. Any item damaged must be returned to Kelly at the expense of the customer, then if liability is accepted by Kelly a full refund including post, packaging and return postage will be refunded. Return postage must be agreed by Kelly before returning the item, as sometimes it is not financially viable to have an item returned if the postage amount is more than the value of the damaged item.
Postal Damage is covered either by the postal service handling delivery of the item or by Kelly, please contact Kelly if your has been damaged in the post or if it has not arrived within the following timeframes:
UK deliveries - 7 working days
European deliveries - 15 working days
Worldwide deliveries - 30 working days
If a Postal claim is required the customer may need to provide the packaging material, the item and the postal details, any claims are the responsibility of customer, but will be supported wherever possible by Kelly provided all requirments of the claim are met by the customer.
Limited Editions (models):
A Limited Edition may be in the form of a set number of models (ie there are 250 Very Little Ones), a set number of moulds (ie Little One was a two mould run) or a set time allocation for ordering (ie a 4 week window for orders).
I reserve the right to produce models in excess of these stated numbers however I will always endeavour to remain true to any quoted figures.
Models cast in materials other than white polyurethane resin are not included in Edition numbers unless otherwise stated (ie the Very Little One Edition is 250 models including all blue and pink copies)
I cannot guarantee availability of models from Limited Editions to provide as replacements for any faulty models. In the event of a replacement model being required, I shall endeavour to provide a like-for-like replacement, but if an Edition is sold out and I am unable to do so, a replacement of value equal to the original selling price of the model being replaced will be offered, or credit given to that value will be offered for future editions, subject to an agreed timeframe.
Good Resin Guarantee:
A model is only as good as the materials it is made of. Whilst I purchase the best materials available to me, I cannot guarantee the quality of resin provided by my suppliers. Because of this, there may be times when a resin model is provided that, whilst on inspection by me appears to be fine, may react during transit or later on during the prepping or painting process.
I am only able to offer a full resin guarantee on models that I have cast for a period of one month from your confirmed receipt of the model and prior to any finishwork being applied.
However, I understand that sometimes resin can present issues at a later date, so in addition to the guarantee above I offer my own "Good Resin Guarantee" on any model that I cast myself (please note the paragraph below). Should a model cast by me present resin issues later than one month from receipt, I will endeavour to provide a replacement subject to the Limited Edition clause above, of equal or greater value to the original selling price of the defective model.
NOTE: I may use outside casting services for some models, in which instance any guarantee is limited to the cover provided by that service alone and must be dealt with directly with them. I will provide all information necessary in such a situation.
